Introduction

Thank you for visiting and using Tako. On this page, you will find the terms and conditions for using our services, both as a visitor and as a user. By visiting or using our services, you are deemed to have understood and agreed to all the terms and conditions of use below. If you do not agree to any, part, or all of these terms and conditions of use, you are not permitted to use our services.

Description

Tako is a monetization platform for digital creators to help them earn additional income from gifts given by their fans. Tako also provides several features to help creators monetize in other forms or through sales, such as Online Stores, Online Auctions, Communities, and other features.

Tako is managed by PT Hobimu Jadi Cuan, a limited liability company established under the laws of the Republic of Indonesia, domiciled and with its office address at Bellezza Office Tower Permata Hijau, South Jakarta, Indonesia 12210.

Definitions

We and/or Tako is a monetization platform as described in the Description section above.
Our services and/or Tako Services refers to a number of features or other types of services provided and directly managed by us, including but not limited to, account registration features, creator registration features, Tako Coin top-up features, creator gifting features, creator auction features, creator store features, creator community features, creator overlay features, and others.
Tako Coin is the currency used within our services. Tako Coins can be increased if users top up through the payment methods/channels listed in Tako.
User refers to a visitor who is a legal entity or individual who registers, uses, or utilizes Tako Services.
Creator refers to a user who has a page on Tako and uses our services to receive support from their supporters.
Supporter refers to a user who uses our services to provide support in any form to our creators.
Personal Data refers to personal data of users voluntarily provided by users to us, including, but not limited to, real name, email address, phone number, or other personal identification information. In addition, in the context of using our platform, personal data also includes an alias or persona name chosen by the user, such as might be used by a Virtual Youtuber.
Intellectual Property Rights are exclusive rights granted over a work arising from intellectual thought put into a tangible form.

User Rights and Obligations

Users must be at least 18 (eighteen) years old or have permission from their parents or guardians when using Tako Services.
Users are obliged to follow all applicable regulations in Tako, including but not limited to, rules regarding content, and electronic information and transmission.
Users agree that their Account and/or Earnings may be suspended/deleted by Tako if they violate the Terms of Use.
Financial support used for payment, which is intended for tips/donations/rewards access, is non-refundable.
Users have the right to protect, secure, and provide full indemnification to Tako (if approved by the Tako team) against any claims and lawsuits of any kind filed by any parties (including government bodies and the police) against the User.
Users agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of Tako Services, use of Tako Services, or access to Tako Services or any available contact, without written permission from Tako.
Users are required to register on Tako using their personal data, which will be used to verify you and will only be used for correspondence with the Tako team, law enforcement, or relevant parties approved by the User.
Users hereby agree to be fully responsible for all content displayed, shown, published, or exhibited within Tako Services. Every content is the User's responsibility not to violate applicable laws in Indonesia.
If a User commits a violation of Rights and Obligations, Tako will take legal action commensurate with the level of violation committed. Such legal action includes, but is not limited to, verbal or written notification to the User, temporary blocking or suspension of Tako Services provided to the User, termination of all Tako Services provided to the User, up to legal lawsuits or judicial actions taken by Tako against the User.
Tax obligations arising now or in the future are fully the responsibility of each party conducting transactions through the use of Tako Services. This includes the responsibility to assess, collect, report, or submit tax information to the authorized authorities in accordance with applicable tax regulations in the Republic of Indonesia.

Creator Rights and Obligations

Creators are required to register on Tako using their personal data, which will be used to verify you and will only be used for correspondence with the Tako team, law enforcement, or relevant parties approved by the Creator.
When creating an account, Creators must provide accurate information.
Creators are responsible for the security of their account and everything that happens to their account while the Creator is logged in or registering.
Creators are responsible for all content displayed, shown, published, or exhibited within Tako Services. Creators are obliged to be responsible for every content created by them and guarantee that such content does not violate applicable laws in Indonesia.
Creators are not allowed to use Tako Services to collect funds for political purposes, for mass organizations with affiliations to lawbreakers, or with the intention of committing illegal acts.
Creators are obliged to comply with all applicable regulations in offering content or works through Tako Services, including but not limited to, laws and regulations governing content, information, and electronic transmission.
Creators are responsible for all content uploaded to the Creator's page. The use of names, brands, logos added by the Creator is entirely the Creator's responsibility.
Creators are allowed to promote their works or content on other platforms.
Creator accounts cannot be sold to other parties.
Creators are strictly prohibited from using Tako Services for illegal or unauthorized purposes that may violate legal provisions in Indonesia, including but not limited to Intellectual Property laws.

Supporter Rights and Obligations

To provide support to Creators, Supporters must at least provide an active email address and active phone number for transaction processing needs.
Supporters are obliged to follow all applicable regulations, including but not limited to, rules regarding content, and electronic information and transmission.
By providing support to Creators, Supporters agree to the chosen payment method and grant full authority and power to Tako to charge every transaction. The support provided by Supporters is non-refundable, non-profitable, and/or non-exchangeable and cannot be withdrawn or charged back.

Prohibited Activities

The following activities are not allowed on Tako. This is almost always due to violating the law, violating ISP regulations, or violating third parties that are our partners. If you are unsure whether your content is prohibited on Tako, please contact us through the content complaint channel listed below with a description or example of the content you wish to bring.

Adult content/Pornography
Anything involving nudity or sexual activity. Created by humans or machines. Whether in the form of text, images, video, or audio.
Transacting for oneself using credit cards or credit services
Transacting to your own Tako account using credit cards or credit services for cash withdrawals, and saving money.
Unauthorized modifications
Modifications made and used without permission from the copyright holder, in the form of cheats, hacks, mods, illegal scripts, and server emulators.
Intellectual property rights
Use of images, videos, music, films, software, logos/symbols, trademarks, and counterfeit goods without permission. This also includes unauthorized sale on behalf of brands or designer products and services that directly violate or facilitate the violation of any third party's trademark, patent, copyright, proprietary rights, or privacy rights.
Illegal products and services
Gambling (casinos, poker, bingo, betting, lottery), hacking services, fake ID providers, hacking services, communication jamming devices, and services that facilitate drug manufacturing.
Fraud / Deceptive marketing
Fake giveaways, 'get rich quick' schemes, fraudulent money-making websites, unrealistic incentives and rewards, multi-level marketing (MLM), network marketing, referral programs, and promoting hatred, violence, harassment, or abuse.
Restricted legal products
Restricted legal products are goods whose use and/or acquisition must comply with applicable regulations and/or standards, including but not limited to alcohol, tobacco, smoking paraphernalia, tobacco products, e-cigarettes, e-liquids, and sex toys.
Financial products and services
Investments, brokerage, forex trading, binary options, unrestricted securities, buy now pay later, cash advances, debt collection, money remitters, currency exchange, insurance, credit repair and credit protection businesses, and branch banks.
Sales and business
Car and truck rentals, vehicle sales, venue rental, pawnbrokers, shipping and forwarding brokers, freight forwarding, psychic and fortune teller services, follower and like sales, VPNs, and cloud storage.
Drugs and supplements (legal and illegal)
Vitamins, dietary supplements, herbal supplements, sports nutrition, products containing any amount of CBD or THC, weight loss supplements, marijuana, and prescription pharmaceutical products.
Currencies and digital assets
Non-fungible tokens (NFTs), cryptocurrencies, virtual currencies, cryptocurrency mining.
Firearms, explosives, and hazardous materials
Firearms, gunpowder, fireworks, peptides, research chemicals, toxic materials, flammable materials, and radioactive materials.

Tako actively monitors all activity, and any violations will result in your content being removed and your account deactivated.

Payments

Tako is not a payment service provider. All forms of transactions using real currency within our services have been fully delegated to third-party services as payment providers. In this case, the third-party providers referred to are:

Flip, a fund transfer company licensed by Bank Indonesia and directly managed by PT Fliptech Lentera Inspirasi Pertiwi, a limited liability company established under the laws of the Republic of Indonesia.
Midtrans, a fund transfer company that is part of GoTo Financial and directly managed by PT Midtrans, a limited liability company established under the laws of the Republic of Indonesia.

By performing any form of transaction using real currency within our services, you agree that:

You are bound by the terms of the third-party payment service providers related to our services, and they will be responsible for all matters related to payment and your data usage.
You will consult with the payment provider directly and before using our services if you have any questions or issues about the information displayed when making a payment.
In transaction disputes, successful and unsuccessful transaction records in Tako are considered final.
You cannot request refunds and/or returns of funds in any form that have been provided through our services.

Service Fees

Creators are charged a service fee by Tako of 5% of the total support received or generated. The service fee for disbursing funds to the creator's bank account or e-wallet is Rp5,000.00 (five thousand rupiah).

Intellectual Property Rights

When a user uploads to Tako Services by uploading or posting content, you grant Tako a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicenseable (through multiple tiers) right to exercise any and all copyright, publicity, trademark, database rights, and intellectual property rights you have in the content, in any media now known or in the future. Furthermore, to the fullest extent permitted by applicable law, you waive moral rights and promise not to assert such rights against Tako.

Users guarantee that they do not violate intellectual property rights when uploading User content to Tako Services. Each User is personally responsible for any intellectual property rights infringement when uploading content on Tako Services.
We uphold the protection of every Creator's intellectual property rights. Therefore, Users must guarantee that all works or content uploaded on Tako Services and/or supported by funding through Tako Services, are entirely the intellectual property of the User, and/or have obtained clear and written permission from the owner of the content/work.
Tako has the right to display, distribute, and disseminate works or content from Creators with the Creator's permission for the purpose of Creator promotion, and the sale and/or delivery of works/content to fans, as well as for the purpose of promoting, improving, and maintaining the security of Tako Services.
When accessing or using Tako Services, you agree to comply with the law and respect the intellectual property rights of others. The use of Tako Services is at all times governed by and subject to laws regarding copyright, trademark, patent, and trade secret, as well as the use of other intellectual property.
You agree not to upload, download, display, perform, transmit, or distribute any information or content that infringes the copyright, trademark, patent, trade secret, or other intellectual property or proprietary rights of any other party.
You agree to comply with laws regarding copyright, trademark, patent, and trade secret ownership and intellectual property use, and you will be solely responsible for any violation of any law and for any intellectual property rights infringement caused by the content you provide by posting, or transmitting, or that is provided or transmitted using your username or user ID.
All content and assets published, created, and/or distributed by Tako within Tako Services, such as text, graphics, logos, audio and/or video media, digital downloads, data compilations, and software, are the property of Tako and are protected by applicable laws in the Unitary State of the Republic of Indonesia.

Miscellaneous

Tako is subject to the Anti-Money Laundering and Counter-Terrorism Financing ("AML/CTF") regulations and statements in Indonesia, both issued by the government and the Financial Services Authority ("OJK").
If we are requested by the authorized parties through a clear letter and statement with specific intentions and purposes, including but not limited to law enforcement, judicial evidence, criminal evidence, and so on, we have the right to provide your personal data to such parties without your consent.
Matters not yet or not sufficiently covered in these terms and conditions will be discussed through deliberation to reach a consensus.
Spelling errors (misspellings) of one or more words in these terms and conditions do not invalidate the terms and conditions. Such spelling errors must be read and interpreted in accordance with Tako's intent.
